It is the customer’s responsibility to be familiar with the General Sales Conditions in force when they start the purchase process.

By accepting these conditions, the customer declares that they are legally of age and have sufficient legal capacity to be bound by these GENERAL SALES CONDITIONS.

Please carefully review the product information to learn about its specific sales conditions. These GENERAL SALES CONDITIONS may be added to or changed via specific clauses or conditions for certain products, especially in terms of the right of withdrawal, exchanges and reimbursement.

ModyHome may change these GENERAL SALES CONDITIONS at any time. These possible changes shall under no circumstances affect purchases that were made prior to the implementation of these changes, which shall always be governed by the GENERAL SALES CONDITIONS in force at the time the purchase was made.

These GENERAL SALES CONDITIONS may be saved and reproduced at any time by customers making a purchase using the options on your Internet browser, and they must be read and accepted before completing the purchase.

All operations between ModyHome and the customer will be governed by the following general conditions:


The prices shown on the website are stated with the Value-Added Tax (VAT) included.

The prices do not include shipping costs, which will be shown when the order is placed.

The prices of the items published on the website may change, but unless otherwise stated in case of error the possible changes will not affect the orders for which an email confirming the purchase has already been sent.

For shipments to a non-European Union member country, there may be tariffs payable by the customer which will be applied when the goods enter the import country.


Orders may be paid by any of the following means:

  • Credit or debit cards.
  • Payment of the customer’s order takes place in real time via the virtual POS once it has been confirmed that the data provided are correct.
  • PayPal.
  • Bank transfer.

In the case of bank transfers, payment is considered received when the amount enters the Moycor Vic SL bank account. No other document or email shall be considered proof of payment.

Payment entails confirmation of the order.

Once the use conditions have been accepted and the purchase has been confirmed, the customer will receive an Order Confirmation email with the details of the transaction.


Home deliveries will be made Monday through Friday. The customer may specify any detail regarding the delivery, as well as the delivery method, according to the options made available by ModyHome at any time. Customers become the owners of the products they have purchased once they have paid the entire price agreed upon.

The customer’s acceptance of the risk regarding the products will occur as soon as they are delivered, regardless of the time when the customer gains ownership of the products. Therefore, ModyHome shall accept no responsibility for any theft, robbery, deterioration, damage or loss of the products that occur after they come under the customer’s ownership.

Each delivery shall be considered completed after making the product available to the customer or to a third party authorised by the customer, as materialised by the tracking system used by the carrier. It is the recipient’s responsibility to check the order when it is delivered and to make any reservations or claims that seem justified at that time, including the possibility of rejecting the packaging if it has been opened or has any clear signs of deterioration (all of this in line with the provisions in the Returns section).

ModyHome shall be released from compliance with its delivery obligations and declines all responsibility for it in the following circumstances:

  • In the event of non-payment by the customer, in accordance with the provisions of the laws in force.
  • Omission or inaccuracy of the information that the customer must provide in the purchase order when placing the order.

If the product ends up being unavailable after the customer has placed the order, they shall be informed of the order cancellation via email.

ModyHome  does not guarantee the permanent availability of its products and is exonerated from any type of responsibility as long as there is no fraudulent breach caused by ModyHome, or if it stems from errors in the unavailability of the remote data transfer networks beyond its control.


The Client has the right to withdraw from the purchase (cancel it) within the first 14 calendar days from the receipt of the product in accordance with the provisions of article 102 TRLGDCU.

Should they wish to exercise their right to revoke the purchase, returns shall be paid by the same means as the payment was made and after ModyHome has received the returned product.

Shipping and return costs shall be paid by the customer. The calculation of costs associated with returns will be determined considering variables such as volume, weight, the nature of the returned products, as well as the geographical location of the customer requesting the return.

In order to exercise this right, the products to be returned must be in perfect condition and retain their original packaging. The customer shall be responsible for any decrease in the product’s value resulting from any handling not needed to establish the nature, characteristics and functioning of the products.

The customer must notify ModyHome of its request for pick-up by sending an email to, and the customer must manage the product pick-up via its agencies.

In the event that the product is defective, ModyHome may offer the customer to exchange it for an equivalent product or provide a discount or the complete return of the amount paid. In any event, whenever the defective product is replaced with one in proper condition, there shall be no reimbursement of the price. In this case, the shipping and return costs will always be paid by ModyHome. 

Before opening a product, the customer should check the intactness and state of the packaging and make sure that the number of packages delivered matches what is stated on the transport document. If the customer detects any anomaly before opening the product, ModyHome asks that they not open the seal or the packaging and that they write ‘accepted with reservations’ on the transport document, specifying the reasons for their reservations.

Likewise, if the product has been damaged during transport, the customer must note this on the carrier’s transport document.

When the customer is also the consumer and user, all our products are guaranteed for manufacturing defects for 3 years within Spain, except for products which state a different timeframe.

The warranty is expressly excluded in the following cases:

  • Transport, accident, improper use and other damages not due to normal use of the product by the customer after the goods have been delivered. This warranty only covers flaws caused by transport which occurred before the goods were received.
  • Transport of the product without the original packaging.
  • Burns, cuts, abrasions, wrinkles, signs, scratches or other damage caused by animals or improper use of the product.
  • Use or contact with chemical products (acids, solvents, dyes, paint, ammonia, hairspray or other haircare products) or treatment with cleaning products not indicated for the specific upholstery of the product under warranty.
  • Colour deterioration caused by the product’s exposure to sunlight or other heat sources.
  • Any personal and/or material damages caused as a consequence of the customer failing to comply with the rules and instructions provided by ModyHome for the product installation, use and maintenance.


ModyHome shall accept no responsibility for total or partial failure to meet the obligations stemming from this contract or for the delay in them if this noncompliance is due to a circumstance involving force majeure, including general, regional or sectoral strikes; floods; fires; pandemics, etc.


The data provided shall be processed by Moycor Vic SL (commercial name ‘ModyHome’), the controller of processing, in order to register the people with whom it has a relationship by their receipt of our products. The data shall be processed in compliance with the contractual relationship (art. 6.1.b of the General Data Protection Regulation) and in fulfilment of legal obligations (art. 6.1.c of the General Data Protection Regulation).
